General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply to all orders and purchases made by customers through the online shop cucina-alpina.com, operated by Cucina Alpina GmbH, Am Stadtrand 53b, 8600 Dübendorf, Switzerland (hereinafter referred to as the “Provider”).

2. Conclusion of Contract

The contract is concluded when the customer completes the order and the Provider accepts the order by sending a confirmation email. The Provider reserves the right to reject orders without stating reasons.

3. Prices

All prices stated in the online shop are in Swiss Francs (CHF) and exclude value added tax (VAT), as the Provider is not subject to VAT. Shipping costs are charged additionally and shown separately.

4. Payment Terms

The customer may pay by credit card, Twint, or other payment methods offered in the online shop. Payment by invoice is not available.

5. Delivery

Delivery is made to the delivery address specified by the customer. The delivery area is Switzerland. Delivery times stated are non-binding unless expressly confirmed in writing as binding. Typical delivery times are 3–7 business days. The Provider is not liable for delivery delays caused by third parties.

If the customer chooses collection instead of delivery, the collection appointment shall be arranged by mutual agreement within 30 days. If the customer does not appear at the agreed appointment, a new appointment will be arranged or the order will be cancelled and refunded. The collection address is Waffenplatzstrasse 51, 8002 Zurich, Switzerland.

6. Retention of Title

The delivered goods remain the property of the Provider until full payment has been received.

7. Warranty and Liability

The customer must inspect the delivered goods immediately upon receipt and report any defects in writing no later than 30 days after receipt. In the event of proven defects, replacement delivery or a credit note will be provided.

The Provider’s liability is limited to intent and gross negligence. Liability for consequential damages is excluded.

8. Right of Withdrawal

The customer has the right to return the received goods within 14 days of receipt, provided that the goods are in their original packaging, undamaged, and unused. Return shipping costs are borne by the customer.

The Provider will refund the purchase price within 30 days after receipt of the returned goods.

9. Product Description and Availability

Product photos and descriptions are non-binding. Furthermore, items may be out of stock. In the event that an out-of-stock item is ordered, the purchase price will be refunded by the Provider.

11. Data Protection

Personal data is treated confidentially and used only for processing the order and for legal purposes. Further details can be found in the Provider’s Privacy Policy, available on the Provider’s website under “Terms and Policies”.

12. Amendments to the GTC

The Provider reserves the right to amend these GTC at any time. Amendments apply to new orders placed after the amendment date.

13. Applicable Law and Jurisdiction

These GTC are governed by Swiss law. The exclusive place of jurisdiction is Dübendorf, Switzerland.

14. Final Provisions

Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected. Invalid or missing provisions shall be replaced by provisions that come closest to the economic purpose of the original provision.
